1. Definitions
- "Workshop" / "We" / "Us" / "Our" — Zephyrgear, located at 119/4 Sri Chan Road, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand.
- "Client" / "You" — any person who brings a watch to the workshop, submits an enquiry, or uses the website.
- "Service" — watch repair, servicing, or restoration work carried out by the Workshop.
- "Watch" — any timepiece left with the Workshop for assessment or service.
- "Agreement" — the terms set out in this document and any written service quotation agreed between both parties.
2. Acceptance of Terms
By using our website or leaving a watch with the Workshop, you confirm that you have read and agree to these terms. You also confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are leaving a watch on behalf of a third party, you confirm that you are authorised to do so.
3. Service Description
Zephyrgear provides watch repair and servicing for mechanical and quartz timepieces, including battery replacement, movement servicing, and restoration of older mechanical watches. Services are available at our workshop in Khon Kaen during published opening hours. We do not currently offer postal or courier-based servicing.
Service availability for specific watch types is subject to the Workshop's assessment. We reserve the right to decline service where a watch requires proprietary tooling or brand-specific parts that are not commercially available.
4. Service Process and Scope
All work is preceded by an assessment of the watch. A written quotation is provided before any service work begins. No work will commence without your explicit agreement to the scope and cost.
If the Workshop discovers additional issues during service that were not identified in the initial assessment, work will pause and you will be contacted before proceeding. No additional charges will be incurred without your agreement.
You may choose to discontinue a service at any point before work begins at no charge. If work has already started, a partial charge may apply to cover assessment and preparation time; this will be discussed with you individually.
5. Timelines
Estimated completion times are provided as guidance. Delays may arise due to parts availability, complexity of the movement, or workshop scheduling. We will notify you promptly if a significant delay is anticipated. Delay in completing a service does not entitle the Client to cancel without charge where work is already in progress.
6. Payment Terms
All prices are in Thai Baht (฿). Published service prices are indicative; the final agreed price is confirmed in the written quotation. Payment is due at collection of the watch. Accepted payment methods are cash (Thai Baht) and bank transfer.
For restoration work exceeding ฿15,000, a deposit of up to 50% may be requested before work begins. This will be stated in the quotation.
If a watch is not collected within 60 days of notification that it is ready, the Workshop reserves the right to charge a storage fee of ฿200 per week thereafter. If the watch remains uncollected for 12 months, the Workshop may, after reasonable written notice, dispose of the watch to recover outstanding service costs.
7. Client Responsibilities
- Provide accurate information about the watch, including any known history of previous repairs or damage.
- Notify the Workshop if the watch has sentimental or high monetary value requiring special care or insurance.
- Collect the watch within a reasonable period after notification that it is ready.
- Use our website and enquiry forms lawfully and without submitting misleading information.
8. Intellectual Property
All content on the Zephyrgear website — including text, images, design, and layout — is the intellectual property of Zephyrgear. You may not reproduce, distribute, or use this content for commercial purposes without written permission.
9. Disclaimers
Watch repair involves working with mechanical components that may be worn, fragile, or have an unknown service history. While we apply reasonable professional skill to all work, we cannot ensure specific timekeeping outcomes or the availability of replacement parts for all watch types.
The Workshop does not provide advice on the monetary or insurance value of watches. Any comments made about a watch's age or condition are for informational purposes only and do not constitute a formal valuation.
10. Limitation of Liability
The Workshop's liability for any loss, damage, or claim arising from a service is limited to the value of the service fee paid. We are not liable for indirect, consequential, or incidental losses, including sentimental value, unless we have been negligent.
We are not liable for pre-existing damage that is undiscovered until the movement is opened, provided we have communicated the finding to you and proceeded only with your agreement.
11. Indemnification
You agree to indemnify and hold harmless Zephyrgear from any claims, costs, or losses arising from your breach of these terms or your provision of inaccurate information about a watch left with us.
12. Termination
Either party may end the service agreement before work begins without obligation. Where work is in progress, termination terms are subject to the scope completed, as described in Section 4. Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.
13. Dispute Resolution
In the event of a dispute, we encourage direct communication in the first instance. Please contact us at [email protected] with a description of the issue. We will respond within 10 working days.
These terms are governed by the laws of the Kingdom of Thailand. Any disputes that cannot be resolved informally shall be subject to the jurisdiction of the courts in Khon Kaen Province, Thailand.
14. General Provisions
- Entire Agreement: These terms, together with any written service quotation, constitute the entire agreement between the parties.
- Severability: If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Assignment: You may not assign your rights under this agreement without written consent from the Workshop.
15. Changes to These Terms
We may update these terms from time to time. Updated terms will be published on this page with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
